1. Agreement to Terms

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”)

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Orufy Technologies Private Limited ("Company," "we," "us," or "our"), concerning your access to and use of the https://WebToNative.com/ website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site" or "Service"). Webtonative is a product of Orufy Technologies Private Limited. You agree that by accessing the Service, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Service and Intellectual Property Rights

The Service involves converting a user's website into a mobile application. Unless otherwise indicated, the Site and the Service are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Service "AS IS" for your information and personal use only. Except as expressly provided in these Terms of Service, no part of the Service and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

3. User Representations

By using the Service, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Service; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the Service through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Service for any illegal or unauthorized purpose; and (7) Your use of the Service will not violate any applicable law or regulation.

4. Products and Payments

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service. You further agree to promptly update your account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. You agree to pay all charges at the prices then in effect for your purchases and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

5. Refund Policy

The Refund Policy is incorporated herein by reference, and you agree to the terms as outlined: WebToNative does not provide refunds. We encourage users to utilize the free demo provided to thoroughly test the service before making a purchase.

6. Mandatory Third-Party Developer Account Fees Disclosure

The fees paid to WebToNative cover only our proprietary conversion technology, build generation, and developer support services. These fees do not include any mandatory, non-negotiable registration or subscription fees required by third-party platforms such as Apple, Google and any other applicable platforms developer accounts which are used for publishing of the apps. By proceeding with your purchase, you acknowledge and agree that you are solely responsible for creating, managing, and maintaining your developer accounts with Apple, Google, and any other applicable platforms, and for paying all associated fees directly to the respective platform owners. WebToNative does not act as a reseller, intermediary, or collection agent for these third-party fees. Please note that additional developer account registration fees may apply for other platforms such as Huawei, Amazon, Samsung, or any other app distribution services that may be introduced in the future. These are external requirements and are not controlled or collected by WebToNative. WebToNative provides technical support and integration capabilities for various third-party SDKs and services, including but not limited to Intercom, AppsFlyer, analytics tools, and similar platforms. However, to use these integrations, you must have an active and valid account with the respective service provider and purchase the required subscription or plan directly from them. WebToNative does not provide, resell, or include any third-party service subscriptions as part of its plans. All licensing, subscription fees, usage charges, and account management responsibilities related to such third-party services rest solely with you and must be handled through the respective provider’s platform. The functionality of these integrations is dependent on the availability, policies, and performance of the third-party service providers, and WebToNative shall not be held responsible for any issues, changes, or disruptions arising from their services.

7. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Service, you agree not to: Systematically retrieve data or other content from the Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us. Make any unauthorized use of the Service, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email. Engage in unauthorized framing of or linking to the Service. Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms of Service and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree that any dispute, claim, or legal proceeding arising out of or in connection with this Terms of Service, your use of the website, or our services shall be subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan, India.
